Welcome to KombuchaBrewLog. By creating an account or using our service, you agree to be bound by these Terms of Service. Please read them carefully before using the application.
1. Definitions
In these Terms of Service, the following definitions apply: "Service" refers to the KombuchaBrewLog web application accessible at kombuchabrewlog.com, including all its features, tools, and content. "User" refers to any individual who creates an account on or uses the Service. "Content" refers to all data, text, recipes, images, and other materials that Users submit, post, or display through the Service. "We", "us", or "our" refers to EI Meidy BAFFOU, the operator of the Service.
2. Acceptance of Terms
By creating an account, making a purchase, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the Service. We recommend that you save or print a copy of these terms for your records.
3. Service Description
KombuchaBrewLog is a web application designed for home kombucha brewers. The Service provides tools for tracking kombucha batches, recording fermentation measurements, managing recipes, maintaining SCOBY (Symbiotic Culture of Bacteria and Yeast) records, logging flavor ingredients for second fermentation, and accessing brewing calculators and guides. The Service is provided as a web application and requires an internet connection to use.
4. Account Registration
To access the full features of the Service, you must create an account by providing accurate and complete information, including a valid email address. You are responsible for maintaining the confidentiality and security of your account credentials. You agree to notify us immediately of any unauthorized use of your account. Each individual may maintain only one account. We reserve the right to suspend or terminate accounts that contain false or misleading information.
5. Pricing & Payment
KombuchaBrewLog offers lifetime access to all features for a one-time payment of €29 (twenty-nine euros), inclusive of applicable taxes. Payment is processed securely through Stripe. Upon successful payment, you are granted immediate, unlimited, and perpetual access to all current features of the Service. While we reserve the right to change pricing for new users in the future, your lifetime access purchase will always be honored regardless of any future pricing changes. Free tools, including brewing calculators and public guides, remain accessible without payment.
6. Refund Policy
In accordance with the EU Consumer Rights Directive (Directive 2011/83/EU), you have the right to withdraw from your purchase within 14 days of payment without giving any reason. To exercise your right of withdrawal, please contact us at hello@kombuchabrewlog.com with your account email address and a clear statement of your decision to withdraw. Upon receiving your refund request within the 14-day period, we will process your refund within 14 days using the same payment method used for the original transaction. After the refund is processed, your access to paid features will be revoked.
7. Acceptable Use
You agree to use the Service only for its intended purpose and in compliance with all applicable laws and regulations. You must not: (a) use the Service for any illegal or unauthorized purpose; (b) attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems and networks; (c) use automated scripts, bots, or scrapers to access or collect data from the Service without our prior written consent; (d) interfere with or disrupt the integrity or performance of the Service; (e) upload or transmit viruses, malware, or any other malicious code; (f) impersonate any person or entity; or (g) use the Service in any manner that could damage, disable, or impair the Service.
8. Intellectual Property
The KombuchaBrewLog brand, name, logo, visual design, user interface, and underlying source code are the exclusive property of EI Meidy BAFFOU and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent. Public recipes shared by users on the platform are shared under the license terms chosen by the respective user. All rights not expressly granted in these Terms are reserved.
9. User Content
You retain full ownership of all Content you create and submit through the Service, including your batches, recipes, SCOBY records, fermentation logs, and any other brewing data. By choosing to make a recipe public on the platform, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that recipe on the KombuchaBrewLog platform for the purpose of operating and promoting the Service. You may revoke this license at any time by making your recipe private or deleting it. You are solely responsible for the Content you submit and represent that you have the right to share such Content.
10. Limitation of Liability
The Service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by applicable law, EI Meidy BAFFOU shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the Service. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid for the Service (€29). KombuchaBrewLog is a tracking and logging tool — we are not liable for any outcomes related to your brewing activities, including but not limited to food safety issues, spoiled batches, or health effects.
11. Disclaimer of Warranties
We strive to provide a reliable and accurate service, but we do not warrant that: (a) the Service will be available at all times without interruption or error; (b) any defects in the Service will be corrected within a specific timeframe; (c) the brewing calculations, ratios, and estimates provided by our calculators are perfectly accurate for all situations — they are intended as general guidance only; or (d) the Service will meet all of your specific requirements. You acknowledge that you use the Service at your own discretion and risk.
12. Termination
We reserve the right to suspend or terminate your account and access to the Service at any time if you violate these Terms of Service or engage in conduct that we reasonably believe is harmful to other users, us, or third parties. In the event of termination for cause, you will not be entitled to a refund. You may delete your account at any time by contacting us at hello@kombuchabrewlog.com. Upon account deletion, all your personal data and Content will be permanently deleted in accordance with our Privacy Policy.
13. Changes to Terms
We may modify these Terms of Service from time to time. When we make material changes, we will provide at least 30 days' advance notice by sending an email to the address associated with your account. Your continued use of the Service after the updated terms take effect constitutes your acceptance of the revised terms. If you do not agree to the updated terms, you may stop using the Service and request account deletion and a prorated refund if applicable.
14. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the French Republic, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France. This choice of jurisdiction does not affect your rights as a consumer under mandatory consumer protection laws of your country of residence.
